The following are the terms and conditions governing content submission to The Marin Pet Gazette newspaper and the marinpetgazette.com website. We ask that you (hereinafter "The Contributor") read the terms of the Agreement (hereinafter " Agreement") carefully.  Please sign the agreement and send it to our editorial offices by fax, or by email with an electronic signature at the bottom of this agreement.

General
Contributor understands that this agreement does not obligate Publisher to publish the Work. By submitting your article, commentary, cartoon, report, photograph, recommendation, review, analysis or other content (individually and collectively "Content") to MPG, the Contributor agrees to these terms and conditions set forth below.

The Content
By submitting your article, commentary, announcement, photograph, report, newsletter, cartoon, letter to the editor, review, analysis or other content ("Content") to this site, you agree to these terms and conditions. Contributor will submit to MPG articles and other content ranging from 50-1,800 words on a topic related to all aspects of pet care, pet training and pet guardianship.  Just about any topic of general interest or importance will do, including human interest and humorous pieces.  Photography and cartoons are welcome.

The Contributor grants to MPG the following rights to the submitted content:

  • The worldwide and perpetual right to publish and distribute submitted content in all versions of MPG, print, electronic or otherwise, in any language and the right to translate and electronically publish and distribute submitted material to other sites or publications owned by or associated with the MPG;
  • The worldwide and perpetual right to include submitted content in advertising and promotion;
  • The worldwide and perpetual right to include submitted content in print and non-print products anywhere in the world.
  • Finally, we may delete any submitted content at any time, without notice to the Contributor though we’ll try to let you know in reasonable time.  Every reasonable effort will be made to allow the Contributor final approval of all published work.  Writer agrees that MPG may assume that the content, as submitted, is in a form acceptable to the Contributor.

The Contributor acknowledges that we may edit their article for clarity, consistency, and professionalism as well as formatting reasons, but will not edit the core content of any submission without permission.

The Contributor represents that s/he is the sole author and owner of submitted content and has the full power and authority, free of any rights of any nature whatsoever by any other person or party, to enter into this Agreement and to grant the rights that are being granted by this Agreement.

Contributor agrees that if published in MPG the content does not, and will not infringe upon any copyright or any proprietary right at common law or otherwise. We strictly adhere to the Copyright Law of the United States Codes, Title 17, Chapter 4, Section 401. Additionally, please notify us if the content has been previously published.

The Contributor will not enter into any subsequent Agreement or understanding with another person or entity that might conflict with the rights granted to the MPG under this Agreement.

MPG is under no obligation to publish the Contributor 's submitted content. Signing this agreement merely allows us to consider your work for publication and publish it at our discretion.

The Contributor Will:
Make certain any hypertext links within submitted content are active and working, and, if possible, obtain any necessary approvals from that company or entity, and make certain that such linking does not violate any copyrights, patents, trademarks, service marks, trade secrets or other proprietary rights.  Our lawyers can help if you have any questions.

Contributor will not submit any content that is defamatory, libelous, obscene, or in violation of any law. We reserve the right to alter this portion of the agreement to accept defamatory, libelous or obscene material if it is funny or otherwise protected by the First Amendment to the United States Constitution.  

Termination of Service:
MPG reserves the right, in its sole discretion, to restrict, suspend, or terminate MPG at any time, for any reason without prior notice or liability. MPG may change, suspend, or discontinue all or any aspects of the MPG at any time.

The Contributor acknowledges that his or her relationship to MPG is that of an independent contractor. As such, the Contributor will not be an employee of MPG, nor will he or she be entitled to any employee benefits, such as medical benefits, life insurance or retirement benefits.

Miscellaneous
The Contributor agrees that this is the entire Agreement between the Contributor and the MPG related to submitted content and that this Agreement supersedes all previous Agreements and understandings relating to submitted content. Any dispute related to this Agreement shall be governed by the laws of the State of California.  Venue for any legal action relating to this agreement shall be lovely Marin County. The Contributor consents to the jurisdiction of the courts and choice of law. The parties agree that California law will be utilized to decide disputes between MPG and Contributor regardless of where the Contributor lives, works or writes or the MPG is read.

MPG reserves any and all rights not expressly stated herein and may assign its rights and duties under this Agreement to any party at any time without notice to you.

The Contributor shall not be allowed to assign this contract in whole or in part. Any attempt to assign this contract shall be null and void.

If any part of this agreement shall be held to be unenforceable, the rest of this agreement should nevertheless remain in full force and effect.

This Agreement constitutes the entire agreement between the parties with respect to the subject matter thereof and supersedes all prior written or oral negotiations, commitments, representations, and agreements with respect thereto.
